Asset Tracing

While assets may be physically or legally located in one jurisdiction, information about them often sits in other countries. Moreover, every jurisdiction is unique in terms of what information is available and how it can be accessed. We use our granular knowledge of locally available official records, proprietary databases, human sources and advanced discovery techniques to identify real estate, banking relationships and money flows, financial investments, jets, vehicles and other prize-assets in support of multijurisdictional recovery efforts.

ASSESSING COLLECTABILITY

Extensive use of secrecy jurisdictions, complex holding structures and professional fiduciaries make it easy for sophisticated defendants to obfuscate ownership and make themselves seemingly judgment-proof. Even when dealing with apparently large corporate defendants, it can be hard to know whether it will still be around by the time an award is entered. We assess the financial stability of corporates, study defendants’ lifestyles and gather evidence of de facto control of seemingly unrelated assets to find hidden wealth. We also identify competing creditors to ensure our clients make informed commercial choices in pursuit of their legal rights.

We help investors in litigation and arbitration to assess the likelihood of achieving a meaningful settlement or collecting damages at every stage of the investment cycle. Equally, we are experts at packaging cases in a way which makes them attractive to potential funders. 

Where clients are unable or unwilling to spend their own funds on litigation /  arbitration or judgment enforcement, we help them to source capital from established providers of legal finance as well as some of the world’s largest private equity firms, to enable them to seek the redress to which they are rightly entitled.

We are adept at identifying legitimate leverage points and creative ways of maximising “nuisance value” to bring about a quicker and better settlement for our clients. This may include gathering information and evidence for media campaigns, identifying discovery targets and, where appropriate, working with clients to achieve redress through criminal process.
